IANAL.

A school (or other institution) can be sued not for the rape or the suicide, but for failing to adequately attempt to prevent the rape (bad security, poor lighting, etc) or for not responding to pleas for help by a student in the days and weeks before they attempt/commit suicide.

They are not guilty of the crime, they are guitly of being negligent, IMHO.
