I don't think Microsoft has to license anything; the only issue is "how 
hard is it to reverse engineer the Windows Media format". Of course, if 
it was easy, it would be done already, but if it was done, I don't 
think Microsoft would have a legal leg to stand on (though they could 
be propped up by the huge pile of request for injunctions they'd send 
out). I think the recent Lexmark decision supports this.
