Well, I expect that if you were to build a "copy" of a patented unit,
and only made minor improvments, such as used better or cheaper
components, a different, more pleasing, visual design, etc, and intended
to patent it the day after your investment in a lottery ticket paid off,
you would fulfill the legal requirements.
