[rescue] "free" solaris license?

I was looking at the Sun site today, and noticed something I hadn't seen
mentioned anywhere.  The free Solaris license appears to specifically
exclude used machines unless they come from Sun/authorised reseller. 
Does this actually mean if I buy a Sun on ebay that I can't legally
download Sol9 for it?  Somehow that seems to damage the concept of free
even more than the $20 to download it for x86 does.
